DO NOT submit personal, sensitive, confidential, regulated, or third-party data (including names, emails, addresses, identifiers, health, financial, legal, or proprietary information).

Any data you submit is provided entirely at your own risk. You acknowledge that the Services are automated, experimental, and not designed for personal data handling.

To the maximum extent permitted by law, Syinx Platforms accepts no responsibility or liability for data you choose to submit, including any loss, disclosure, misuse, or consequence arising from that submission.

1. Binding Acceptance

By accessing, downloading, using, interacting with, or relying upon any application, platform, website, API, AI model, output, or service provided by Syinx Platforms Pty Ltd (“Syinx”, “we”, “us”, “our”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

2. Nature of Services – Free and Paid

Services may be provided free of charge or monetised via subscriptions, usage-based fees, or enterprise arrangements. To the maximum extent permitted by law, unless expressly agreed in writing, no service levels, warranties, representations, duties of care, fiduciary duties, or professional obligations are created by any use of the Services.

3. Company Structure and Capacity Disclosure

Syinx Platforms is operated by a single individual with no employees, agents, contractors, or dedicated support personnel. You acknowledge that no obligation exists to provide support, response times, monitoring, supervision, escalation, or intervention.

4. Nature of AI Services (Critical Disclosure)

The Services are automated, probabilistic, non-deterministic, experimental, and may change or be withdrawn at any time. AI systems do not reason, verify facts, or guarantee correctness. Outputs may be incorrect, incomplete, misleading, fabricated, biased, unsafe, offensive, outdated, or unlawful in some jurisdictions.

5. No Advice of Any Kind

Syinx Platforms does NOT provide legal, medical, financial, tax, accounting, safety, compliance, investment, or professional advice of any kind. Any output that appears to be advice is not advice and must not be relied upon. You are solely responsible for obtaining independent professional advice.

6. No Reliance – Assumption of Risk

You must not rely on any output, recommendation, inference, prediction, or result. Use of the Services is entirely at your own risk. You assume all risks associated with use, including risks of error, omission, interruption, or inaccuracy.

7. Personal Information – User Warranty & Responsibility

You warrant that you will not submit personal, sensitive, confidential, regulated, or third-party data unless you are legally authorised to do so. You acknowledge that the Services are not designed for personal data processing. Any submission of such data is done voluntarily, knowingly, and entirely at your own risk.

8. Data Handling – No Confidentiality

To the maximum extent permitted by law, Syinx makes no guarantees regarding data retention, availability, confidentiality, integrity, or security. Data may be logged, processed, anonymised, deleted, reused for system improvement, or lost due to technical failure. Any handling of personal information (if any) is governed solely by the Privacy Policy.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “AS IS”, “AS AVAILABLE”, and “WITH ALL FAULTS”, without warranties or guarantees of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Syinx Platforms shall not be liable for any loss or damage whatsoever, whether direct, indirect, incidental, consequential, special, exemplary, economic, reputational, or otherwise, arising from or relating to the Services, data submission, or reliance on outputs, even if foreseeable.

11. Australian Consumer Law

Nothing in these Terms excludes or limits rights that cannot be excluded under the Australian Consumer Law. Where liability cannot be excluded, Syinx’s liability is limited, at our option, to re-supplying the Services or paying the cost of re-supply.

12. Indemnity

You agree to indemnify and hold harmless Syinx Platforms from all claims, losses, damages, liabilities, penalties, and legal costs arising from your breach of these Terms, submission of unauthorised data, reliance on outputs, unlawful use of the Services, or any third-party claim caused by your conduct.

13. Prohibited and High-Risk Use

Use of the Services for life-critical, safety-critical, medical, legal, financial, regulatory, military, surveillance, or emergency decision-making purposes is strictly prohibited and entirely at your own risk.

14. Intellectual Property & Outputs

All intellectual property in the Services, systems, and models remains the exclusive property of Syinx Platforms. You receive a limited, revocable, non-exclusive, non-transferable licence to use outputs for lawful purposes only. No ownership in outputs is transferred.

15. Suspension, Modification, and Termination

Syinx may suspend, modify, restrict, or discontinue any Service at any time without notice or liability. Fees paid are non-refundable unless required by law.

16. No Duty to Monitor

Syinx Platforms has no obligation to monitor content, review outputs, detect misuse, or prevent harm.

17. Governing Law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of Australian courts.

18. Entire Agreement & Severability

These Terms constitute the entire agreement between you and Syinx Platforms. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

19. Technical Evolution: Syinx Platforms may modify, retrain, replace, or restructure systems, models, or architecture at any time. Consistency, accuracy, or backward compatibility is not guaranteed.
